Introduction

This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or otherwise collected by us, offline or online, including through our website (Site). In this Privacy Policy we, us or our means Easywheels Pty Ltd ABN 85 636 472 681.

In this policy we explain how and why we collect personal information about individuals, how we use it, and what controls individuals have over our use of it.

We are committed to complying with Commonwealth legislation (the Act and the APPs) that deals with how businesses may collect, hold and use personal information about individuals and to protecting and safeguarding the privacy of individuals when they deal with us.

What are the types of personal information we collect and hold?

Some information provided to us by clients, customers and other parties might be considered private or personal. However, without such information we would not be able to carry on our business activities and provide our services. We will only collect such personal information if it is necessary for one of our functions or activities. The kinds of personal information that we may collect and hold in respect of individuals include: 

- names;
- contact details and identification information;
- financial information, including information about transactions and trading history with us;
- information about your credit score.
- information about your access and use of our Site ,your browser session and geo-location data, device and network  information, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour;
- additional personal information that you provide to us, directly or indirectly, through your use of our Site, associated applications, associated social media platforms and/or accounts from which you permit us to collect information; and
- any other personal information requested by us and/or provided by you or a third party.

In particular, personal information is collected in the following situations by us:

- if an individual contacts us we may keep a record of that communication or correspondence;
- If an individual submits an application or curriculum vitae or another form required to be completed by an individual to enable and/or facilitate services and or/employment to be provided by Easywheels;
- when applying for and/or establishing and/or accessing an account with us or ordering products or services from us;
- when conducting certain types of transactions such as cheque or credit card purchases or refunds;
- when an individual submits their contact details to be included on our mailing lists;
- when an order is placed with us to purchase goods we may require individuals to provide us with contact information including name, address, telephone number or email address and financial information (such as credit card details) for the purposes of processing and fulfilling such an order;
- when conducting customer surveys, we may keep a record of information you provide to us, including your preferences and/or opinions;
- when a referral is received from a third party.

We may collect these types of personal information directly from you or from third parties. We usually collect personal information about individuals directly from the individual. However, sometimes we may need to collect personal information about individuals from third parties for the purposes described below in this policy. The circumstances in which we may need to do this include, for example, where we need information from a third party to assist us to process an application or an order (such as to verify information an individual has provided or to assess the individual’s circumstances) or to assist us to locate or communicate with the individual.

We have security measures in place to protect your personal information whilst under our control. These measures include controls around access to our premises and systems, requiring our employees to comply with this policy and requiring third party service providers to keep the information we provide to them confidential. Personal information is de-identified, deleted and destroyed securely when no longer required by us.

    Why we collect and hold your personal information

    We will only collect and hold your personal information where it is reasonably necessary to enable us to carry on our business and provide products and services to you. If you do not provide this information it may not be possible for us to conduct business with you or supply you with the products or services you require. 

      Why we use and disclose your personal information

      We do not rent, sell, or share Users’ information with third parties except as described in this Privacy Policy.

      We may use the information for the following:
      • To apply for vehicle subscription via our Loopit booking tool, at your explicit request.
      • Communicating with you – sending you notices regarding our services, providing you with technical information and responding to any customer service issue you may have;
      • To communicate with you and to keep you informed of our latest updates and services;
      • To serve you advertisements when you use our Site; 
      • To market our websites and products (see more under "Marketing"); 
      • Conducting statistical and analytical purposes, intended to improve the Site. 
      • To disclose it to your vehicles manufacturer (if you have purchased the vehicle from EasyWheels. Pty Ltd) for purposes such as managing safety issues and warranty claims, roadside assistance registration, for their business purposes including to resolve any privacy complaints and co-ordinating marketing by these manufacturers and/or its dealership network, related entities and service providers;

      In addition to the different uses listed above, we may transfer or disclose Personal Information to our subsidiaries, affiliated companies and subcontractors.

      In addition to the purposes listed in this Privacy Policy, we may share Personal Information with our trusted third party providers, who may be located in different jurisdictions across the world, for any of the following purposes: 
      • Hosting and operating our Site;
      • Relevant vehicles manufacturer (if you have purchased the vehicle from EasyWheels. Pty Ltd for purposes such as managing safety issues and warranty claims, roadside assistance registration, for their business purposes including to resolve any privacy complaints 
      • To book a vehicle service on your behalf
      • Completing a Roadside Assistance Claim on your behalf, should you request us to.
      • Completing an Insurance claim on your behalf, should you request us to.
      • Providing you with our services, including providing a personalized display of our Site;
      • Storing and processing such information on our behalf; 
      • Serving you with advertisements and assist us in evaluating the success of our advertising campaigns and help us retarget any of our users;
      • Providing you with marketing offers and promotional materials related to our Site and services; 
      • Performing research, technical diagnostics or analytics;
      We may also disclose information if we have good faith to believe that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our Agreement), including investigations of potential violations thereof; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.

      Cookies and web beacons

      Our websites and digital platforms use information from your web browser (known as cookies) and information about your use of our website (known as click stream data) to help analyse how users interact with the sites and improve navigation experience. The cookie and click stream data we collect may include, for example:

      - your IP address;
      - your operating system and browser type;
      - the date and time that you visit our website; and
      - the amount of time you spend on our website.

      Our websites also use data analytic and advertising services that utilise cookies to collect information on an individuals interests and demographics for reporting purposes, which includes anonymous information about your:

      - age;
      - gender; and
      - interests.

      An individual may refuse the use of cookies by selecting the appropriate settings on their browser, however this may mean they may not be able to use the full functionality of the website.

      Third party vendors, including Google and Facebook, use cookies to display relevant adverts based on a user's past visits to our websites. If you do not wish to receive these you should visit the vendor's website for details of how you can opt out.
      We may use web beacons on our Site from time to time. Web beacons (also known as Clear GIFs) are small pieces of code placed on a web page to monitor the visitor’s behaviour and collect data about the visitor’s viewing of a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.

      Links to other websites

      Our Site may contain links to other websites. We do not have any control over those websites and we are not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy.

      How you can access your personal information and correct it

      You have the right to request access to the personal information we hold about you. You also have the right to request that your personal information be corrected, completed, made accurate or removed from our records (subject to any exemptions which may be applicable under the relevant privacy laws). If we refuse or limit your request we will explain why. We will respond to your request within 30 days.

      Privacy complaints and enquiries

      If you have a complaint or enquiry about the treatment of your personal information please contact us. It would assist us if you could indicate that you are making a Privacy Complaint or a "Privacy Enquiry". We will investigate your complaint and respond within 30 days setting out the steps we will take to resolve your concerns.
      If you are not satisfied with the outcome you may ask the Office of the Australian Information Commissioner (OAIC) to investigate your complaint. Further information on the OAIC complaint process is available at www.oaic.gov.au. 

      How do we safeguard your information?

      We take great care in implementing and maintaining the security of the Site and your information.  We employ industry standard procedures and policies to ensure the safety of the information we collect and retain, and prevent unauthorised use of any such information, and we require any third party to comply with similar security requirements, in accordance with this Privacy Policy . Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorised access or abuse our Site, and we make no warranty, express, implied or otherwise, that we will prevent such access.
